Purposes of processing and legal bases

  • Management of contact, quotation, and support requests (Art. 6(1)(b) GDPR – performance of pre-contractual/contractual measures).
  • Administrative, fiscal, and legal obligations (Art. 6(1)(c) GDPR – legal obligation).
  • Defence of rights in judicial or extrajudicial proceedings (Art. 6(1)(f) GDPR – legitimate interest of the Controller).
  • Technical analysis and website security (Art. 6(1)(f) GDPR – legitimate interest, limited to necessary data).
  • Commercial communications and marketing only with prior consent, where required (Art. 6(1)(a) GDPR).

Providing data for contractual/pre-contractual purposes is necessary; failure to provide such data may prevent handling of the request. Where consent is required, it may be withdrawn at any time without affecting the lawfulness of processing carried out before withdrawal.

Recipients, Transfers, Security, and Retention

Data recipients

Data may be processed by authorised OFEM S.R.L. personnel and by qualified suppliers acting as data processors (e.g. hosting, IT services, e-mail management, CRM, website maintenance-de, technical/administrative consultants), within the limits of the stated purposes.

Transfers outside the EU/EEA
If certain technical services involve transfers to third countries, OFEM S.R.L. applies the safeguards set out in Articles 44 et seq. GDPR (e.g. standard contractual clauses, adequacy decisions, or equivalent measures).

Retention periods

  • Contact requests and commercial leads: up to 24 months from collection, unless a different contractual relationship applies.
  • Contractual/administrative data: for the periods required by civil and tax obligations (typically up to 10 years).
  • Data processed on marketing consent: until consent is withdrawn, with periodic relevance checks.
  • Technical and security logs: for the time strictly necessary for technical management and service security.

Security
OFEM S.R.L. adopts appropriate technical and organisational measures to protect data against unauthorised access, loss, alteration, or improper disclosure.

As a data subject, you may exercise the rights provided by Articles 15-22 GDPR, including access, rectification, erasure, restriction, objection to processing, data portability, and withdrawal of consent (where given).
